I thought the berm along 18th Ave. was city property.

No, it belongs to the Homeowners Association but we are required by the City of Eugene to maintain the berm and keep the shrubs and trees pruned. Berm maintenance along with liability insurance are the main expenses of the association.

Who enforces the association CC&Rs?

This question is interesting. Most of the association CC&Rs are basically the same as City of Eugene ordinances. It appears the CC&Rs were written by the original developer mainly for control during development because there was no provision made for funding post-development enforcement. While the by-laws do provide foe modifying the CC&Rs and by-laws, the quorum requirements make that almost impossible. Because most of the CC&Rs are the same a city ordinances. any homeowner can initiate a complaint to the City of Eugene requesting enforcement. There is a copy of the complaint form on this web site.
